1.1) This agreement describes the terms on which SANCO of 28 - 32 Wellington Road, St John's Wood, London, England NW8 9SP ("SANCO", "We", or "Us") allows individuals to proceed to download and use ("Use") the Mobile Club Manager computer game software together with associated media, materials and other documentation (together "MCM") By checking the box of the "Please check this box to accept our Terms & Conditions" field [on the Registration page], you accept each of the terms and conditions set out below, including those terms and conditions incorporated by reference.
1.2) You agree that MCM is provided to you by SANCO under the terms of this agreement with you and that Use and attempted Use of MCM is at your own risk and responsibility. Access to MCM is permitted on an "AS IS" basis
1.3) In no event shall SANCO or any member of the group of companies of which it forms part, be liable for any loss or damage arising from Use or attempted Use of MCM.
1.4) SANCO does not warrant that Use of MCM will not damage your computer equipment, that its operation will be uninterrupted and error-free, or that defects will be corrected.
1.5) SANCO has limited control over the input from Users, and makes no representations or warranties about them.
1.6) You agree that SANCO is not responsible for inability to Use MCM, or for any errors or omissions, or for the results obtained from Use or attempted Use of MCM.
USE AND CHARGES
2.1) You agree that Use of MCM and any data downloaded in connection with your Use of MCM is at your own risk. You agree to ensure that you are entitled to download MCM and any data, and you must first scan for computer viruses and other disabling applications.
2.2) You agree not to download or attempt to download MCM on equipment that does not comply with the minimum system requirements specified.
2.3) SANCO does not endorse and is not responsible for any form of transmission in connection with MCM which does not originate from SANCO directly.
2.4) You will Use MCM (including your unique pin number), and participate in all connected activities in a bona fide manner and in the utmost of good faith, in accordance with our rules and instructions, as set out in our "How to Play" page which is accessible via this link.
2.5) If you do not comply with clause 2.4, your licence to Use MCM may be terminated by us immediately and you will be disqualified from all further participation, without any right to compensation.
2.6) You may not create and manage more than one account at MCM.
2.7) You may only use your own personal details to register the game (both on the WAP site and the website).
2.8) By downloading MCM to your phone, you agree to all subsequent WAP/GPRS charges (refer to your Network Service Provider for rates).
2.12) You may not buy and/or sell players for the purposes of artificially giving another manager in your league money, this makes for unfairness in the competition.
2.13) You must not make bids for any players that you have no intention of purchasing. Similarly, you must not negotiate a bid that has been made for one of your players if you have no intention of selling them.
2.14) Everyone who wants to play MCM has to create his/her own personal account. You may not assist someone in creating his/or account or create an account for someone else.
2.15) By arranging or accepting a "1 on 1 Friendly" you agree to all subsequent SMS charges.
2.16) By initiating or negotiating a Transfer, you agree to all subsequent SMS changes.
2.17) You agree to abide by the terms of our Premium SMS service, details of which are available via this link.
2.18) You agree that we are entitled to proceed on the basis that any transaction or activity which is undertaken via your unique pin number is valid, and that you shall be responsible for all the consequences, including financial consequences, thereof. You shall keep your unique pin number safe at all times and shall not disclose it to any other party.
Updates
3.1) From time to time we may release new or updated versions of MCM, or bug fixers of MCM. If you choose to download any of these, you will incur charges from your provider.
3.2) You agree that if you do not download any such new or updated versions or any bug fixers, that your ability to participate in MCM may be affected or prevented.
3.3) We shall release add-ons (training games) from time to time. These can be downloaded by a text trigger, charged at standard network rates, and in addition, we will charge you £1.50 per add-on.
CONDITIONS, WARRANTIES AND LIABILITIES
4.1) You acknowledge and agree that SANCO is not responsible for the security of any payment method made available by any third party for purchase of MCM or other materials and that you use any such payment method at your own risk.
4.2) To the maximum extent permitted by law, SANCO hereby disclaims all warranties and conditions whether express, implied or statutory with regard to MCM and its content, including, without limitation, those of fitness for a particular purpose, title and non-infringement.
4.3) You agree that in no event shall SANCO be liable for any direct, special, indirect or consequential loss or damage of any kind, whether arising in contract, negligence or other tortious action, as a result of or in connection with the Use or attempted Use or the performance of MCM. You acknowledge that this exclusion of liability by SANCO is reasonable as MCM has been supplied to you for interactive use.
INDEMNITY
5.1) You will ensure that each person who Uses or attempts to Use the MCM complies with the terms and conditions of this agreement and the terms of the user agreements. You undertake to keep SANCO, its directors, officers, and employees indemnified against any liabilities, losses, expenses or other costs it or they reasonably incur arising from any breach of the terms hereof by you or any person who Uses or attempts to Use MCM.
GOVERNING LAW
6.1) This Agreement shall be governed by and construed in accordance with English law, and the English courts shall have non-exclusive jurisdiction in connection with all matters relating to these Terms.
By checking the box beside "Please check this box to accept our Terms & Conditions" on the Registration page, you agree to be bound by these terms and conditions.
Ownership
Mobile Club Manager is owned and operated by SANCO. All content included on the Mobile Club Manager game and website, such as text, graphics, logos, button icons and images, is the property of SANCO and protected by international copyright laws.
